TGS Management Company, LLC (“TGS,” “we,” “us,” or “our”), knows that data privacy is very important to you. We have created this privacy policy (the “Privacy Policy”) to describe how we collect and process information from and about you through our website located at www.tgsmc.com (the “Site”). By accessing or using the Site, or otherwise manifesting your assent to this Privacy Policy, you agree to be bound by this Privacy Policy. If you are accepting this Privacy Policy on behalf of your employer or another organization, you hereby certify that you are authorized to bind such party to the terms of this Privacy Policy. If you do not agree to (or cannot comply with) all of the terms of this Privacy Policy, you may not access or use the Site.

I. The Information We Collect

While operating the Site, we may collect or receive the following types of information about you, which may include personal information.

1. Contact Information

We may collect contact information through our Site such as your name, email address, phone number, business contact data (e.g., title, company name, office phone number and company email address), and any information you provide in messages to us (“Contact Information”). We use Contact Information for the purpose it was submitted, such as responding to your inquiries or  providing you with requested information.

2. Information obtained automatically from your online activity 

When visitors access or use the Site, we use cookies that are necessary for proper operation of the Site such as session cookies, which are essential to navigating a website. For example, session cookies allow us to remember users when they move between pages on our Site so they can avoid having to start at the beginning each time they visit. We may also use cookies to collect certain usage information such as information regarding your device, IP address and/or browser information.  If you do not want any cookies placed on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your internet browser’s documentation for information on how to do this. However, if you choose to do so, our Site will not operate properly. We also automatically collect access logs, PHP error logs and slow error logs (which may contain IP addresses and/or browser information).

3. Social Media

TGS maintains a page on Linkedin (“Linkedin Page”), where personal information may be collected from and about visitors by Linkedin.  Linkedin may provide us with aggregate information and analysis about visitors’ access and use of our Linkedin Page. This allows us to better understand and analyze our user growth, general demographic information about the users of our Linkedin Page and their interaction with content we make available on our Linkedin Page. Overall, this information may be used to help us understand the types of visitors and users of our Linkedin Page and its content.

This Privacy Policy does not cover Personal Information collected by Linkedin or its privacy and security practices.  If you have any questions about Linkedin’s privacy or security practices, please review its privacy policies and terms of service.

4. Information Use and Sharing

We may use and share your personal information as set forth below:

  • To provide, monitor, support, analyze, and improve the Site;
  • To troubleshoot and resolve errors on the Site;
  • To communicate with you regarding the Site and fulfill your requests for information;
  • To protect the safety and security of our Site and business;
  • To third-party contractors and service providers that provide services to us in the operation of our business and assistance with the Site, such as consulting service organizations, IT providers, web-hosting providers, and cloud service providers, among others;
  • To fulfill our legal and regulatory requirements, and comply with applicable law (e.g., comply with a subpoena or similar legal process), and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or respond to a government request;
  • To assess or complete a corporate sale, merger, reorganization, sale of assets, dissolution, investment, or similar corporate event where we expect that your personal information will be part of the transferred assets; and
  • Otherwise, with your consent.

5. User Access and Choice

If the personal information you have provided changes, you may correct or update it by contacting us under Section IV.2 (“Contacting Us”) of this Privacy Policy.

We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. We will retain and use your information as necessary to comply with our legal and/or regulatory obligations, resolve disputes, and enforce our agreements.

6. External Websites and Third Parties

Unless explicitly stated otherwise, our Privacy Policy addresses only our use and disclosure of information we collect from and/or about you in your interactions with TGS. If you choose to disclose information to third parties, the use and disclosure restrictions contained in this Privacy Policy will not apply, as we do not control the privacy policies of such third parties, nor are we subject to them.

The Site may also contain hyperlinks to other third-party websites or apps (“Other Properties”). We have no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or Other Properties to which we provide hyperlinks. As such, we are not responsible for the content or the privacy policies of those Other Properties. You should check the applicable third-party privacy policy and terms of use when visiting any Other Properties.

7. Security 

We follow commercially reasonable and generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. Please understand, however, that no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. 8. Children’s Privacy

Our Site is only available to individuals aged 18 or older, and we do not knowingly collect personal information from any person under the age of 18. If an individual under the age of 18 has provided us with Personal Information, a parent or guardian of that child may contact us and request that such information be deleted, and we will endeavor to delete that information from our databases.

9. TGS Does Not Sell Personal Information or Track Visitors

We do not sell personal information or track visitors to our Site. Therefore, we do not monitor any opt-out mechanisms or browser settings such as do-not-track or global privacy control.

II. Notice to Nevada Residents

We do not sell your personal information as defined under Nevada law. Nonetheless, if you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by contacting us under Section IV.2 (Contacting Us)” of this Privacy Policy with the subject line “Nevada Do Not Sell Request.”

III. CCPA Notice to California Residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”) gives California residents and households (“consumers” or “you”) additional rights regarding their personal information as set forth in this Section III of our Privacy Policy.

We may collect the categories of personal information listed in the tables below for the specific business purposes listed next to them.

TGS determines the retention periods of each category of personal information based on the following criteria:

  • The purposes for which TGS processes the personal information (TGS needs to retain the data as long as necessary for such purposes); and
  • Tax, legal and regulatory obligations and requirements (e.g., laws or regulation may set, or recommend, a minimum period for retention of your personal information).

Right to Know About Your Personal Information

  • Specific pieces of personal information: If you would like to know and access the specific pieces of personal information that we have collected about you, please contact us as described under Section III.5 of this Privacy Policy. You may exercise this right up to two times in any 12-month period.
  • Categories of personal information sold: We do not sell any personal information obtained about you, nor have we done so in the past.
  • Categories of personal information shared: We do not, and have not in the past twelve months, shared any personal information for the purpose of cross-context behavioral advertising.

Right to Request Deletion

You have the right to request deletion of your personal information. We will honor such request if we can but might not be able to fulfill your request if we (or our service providers) are required to retain your personal information. Examples of such exceptions are:

  • Completing a transaction or performing a contract we have with you;
  • Detecting and addressing data security incidents, and repairing or upkeep of our IT systems;
  • Protecting against fraud or other illegal activity;
  • Complying with applicable law or a legal obligation, or to exercise rights under the law (e.g., the right to free speech); or

Right to Request Correction

You have the right to request that we correct inaccurate personal information that we maintain about you. We will honor such request but might not be able to fulfill your request if it is impossible to do so or would involve disproportionate effort, or if we have a good-faith, reasonable, and documented belief that a request to correct is fraudulent or abusive.

Right to Opt-Out of the Sale or Sharing of Personal Information

You have the right to opt-out of the sale or sharing of personal information. Please note, however, that we do not sell or share for the purpose of cross-context behavioral advertising any personal information obtained about you, nor have we done so in the past.

Right to Limit the Use and Disclosure of Sensitive Personal Information

You have the right to limit the use and disclosure of sensitive personal information. Please note, however, that we only collect the information mentioned in this Privacy Policy, and do not use or disclose it for any purposes that are covered by this right (nor have we done so in the past).

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. We will not (i) deny you products or services, (ii) charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties, (iii) provide you a different level or quality of products or services, and (iv) suggest that you may receive a different price or rate for products or services or a different level or quality of products or services.

Right to Designate an Authorized Agent

If you submit a request to know or delete your personal information using an authorized agent, we may require that you (i) provide the authorized agent written permission to act on your behalf, and (ii) verify their identity directly with us.

What we need to know to fulfill your request

The verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information related to you.

How you will hear back from us

We will confirm receipt of a verifiable consumer request within then (10) business days of its receipt. We will endeavor to respond to a verifiable consumer request within forty-five (45) calendar days of its receipt. If we require more time, we will notify you of the extension and provide an explanation of the reason for the extension in writing, and we will provide you with a response no later than ninety (90) calendar days of receipt of the request. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We may charge a reasonable fee to process or respond to your verifiable consumer requests if they are excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will inform you of the reasons for this decision and provide you with a cost estimate before completing your request.

Right to Opt-Out of the Sale and/or Sharing of Personal Information

As mentioned above, we do not sell or share your personal information for the purpose of cross-context behavioral advertising.

6. Other California Privacy Rights. 

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. To submit such a request, please contact us as explained at the end of this Privacy Policy.

1. Changes to this Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may update this Privacy Policy from time to time without notice to you. We will indicate at the top of this Privacy Policy when it was most recently updated, and we encourage you to revisit this page periodically to stay aware of any changes. By accessing the Site after we change this Privacy Policy, you are deemed to have accepted such changes.
